This page sets out your rights under the Australian Consumer Law, the warranties we provide on repairs, replacement parts and items from our shop, and the steps to take if a problem arises with a repair or with an item purchased from us.
Summary
- Your rights under the Australian Consumer Law apply to our repairs and to the items we sell, and cannot be excluded.
- Repairs carry a 90-day warranty on the specific repair we performed. Replacement parts we fit carry their own warranty: 3 to 12 months for new parts, depending on the part, and 90 days for refurbished parts. Warranties begin when you collect your device.
- Items from our shop carry a warranty of 3 to 12 months, depending on the item.
- To make a claim, contact us and bring the device or item to our shop. If the fault is covered, it is rectified at no cost to you.
- We do not offer change-of-mind returns. This does not affect your rights under the Australian Consumer Law if an item is faulty or does not meet the consumer guarantees.
Your rights under the Australian Consumer Law
When we repair your device, the law guarantees that the work will be carried out with due care and skill, that it will be fit for any purpose you made known to us, and that it will be completed within a reasonable time where no time was agreed.
When we sell you a laptop or a part, the law guarantees that it is of acceptable quality, matches its description and is fit for any purpose you made known to us. For refurbished goods, acceptable quality takes into account the item's age, price and condition. A defect we specifically drew to your attention before purchase does not count against it.
Remedies for a failure
Your entitlements depend on whether the failure is major or minor:
- Major failure. For goods, you may choose a refund or a replacement, or keep the item and be compensated for its drop in value. For a repair, you may cancel and receive a refund for the unused portion, or be compensated for its reduced value.
- Minor failure. For goods, we may choose to repair, replace or refund. For a repair, we must rectify the problem within a reasonable time. If we refuse, or do not do so within a reasonable time, you may have it rectified elsewhere and recover the reasonable cost from us, or reject the item and choose a refund or replacement, or cancel the repair and receive a refund for the unused portion.
- You are also entitled to compensation for any other reasonably foreseeable loss or damage caused by the failure.
These rights do not end when a warranty period ends. The ACCC explains them in more detail at accc.gov.au (opens in a new tab).
Our repair and parts warranty
In addition to your rights under the Australian Consumer Law, Laptop Clinic provides a warranty on its repairs and on the parts it fits. Repairs carry a 90-day warranty on the specific repair we performed. Replacement parts we fit carry their own warranty: 3 to 12 months for new parts, depending on the part, and 90 days for refurbished parts. Warranties begin when you collect your device.
- The repair. If a problem with the repair we performed appears within 90 days, we rectify it at no additional cost to you.
- Replacement parts. If a part we fitted fails within its warranty period, we replace it free of charge, including the labour to fit the replacement. Please ask us which period applies to a new part.
Scope of the warranty
The repair warranty covers the specific repair we performed, and each part we fitted carries its own part warranty. Neither covers faults elsewhere in the computer that are unrelated to our repair or to a part we fitted. We can provide a quote to repair such faults.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
The benefits to the consumer given by the warranty are in addition to other rights and remedies of the consumer under a law in relation to the goods or services to which the warranty relates.
How to make a warranty claim
- Contact us and describe the problem: call 0409 084 077 or 07 3162 4168, email info@laptopclinic.com.au, or visit the shop.
- Bring the device or item to Laptop Clinic, Shop 3/121 Oxley Station Rd, Oxley QLD 4075, during opening hours.
- We assess it. If the fault is covered, it is rectified at no cost to you.
- If it is not covered by our warranty, we will tell you, and can provide a quote for the repair. Your rights under the Australian Consumer Law continue to apply.
Each claim is assessed on its circumstances. Before taking any further step, we explain everything that will happen, and we proceed only with your consent.
Laptops and parts from our shop
The consumer guarantees above apply to the items we sell, including refurbished items. Items from our shop also carry a warranty of 3 to 12 months, depending on the item; please ask which period applies before purchasing. To make a claim, follow the steps under How to make a warranty claim.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Change of mind
We do not offer change-of-mind returns, for example where you no longer want an item or selected the wrong item yourself. The law does not require them. This does not affect your rights under the Australian Consumer Law if an item is faulty or does not meet the consumer guarantees. If we advised that a part would suit your device and it does not, that is not a change of mind, and the consumer guarantees apply.
How refunds are made
- Where a refund is due for an item, we refund the price paid. For a repair, the refund covers the unused portion of the service, as set out under Remedies for a failure.
- No deduction is made for the use you have had of the item.
- We may need to inspect the item or device first to confirm the problem.
- If we confirm a problem with an item we sold you, we reimburse the reasonable costs you have already incurred in returning it to us.
- We deal directly with problems relating to items we sold or repairs we carried out, and do not refer you to the manufacturer instead.
